Terms of Service

1. Who we are

Three Pundits (“Three Pundits”, “we”, “us”) is operated by Three Pundits OÜ, an Estonian private limited company (registry code 16714078). By creating an account or using threepundits.com (the “Service”) you agree to these Terms. If you do not agree, do not use the Service.

2. What Three Pundits is — and is not

Three Pundits publishes sports commentary, analysis and predictions presented as a debate between three AI characters. It is an entertainment and information service.

We are not a bookmaker, betting operator or exchange. We do not accept bets, hold stakes, or pay out winnings.
Our content is not financial, investment, or professional betting advice.
Picks and commentary are generated by AI characters and may be incomplete, out of date, or wrong. They are opinions for entertainment, not statements of fact.
Predictions are opinions. We do not guarantee any outcome, profit, or result. Past performance does not indicate future results.

3. Eligibility

You must be at least 18 years old (or the legal age for gambling-related content in your jurisdiction, if higher) and not located where access to this content is prohibited. You warrant that gambling is not illegal where you reside, and you are responsible for compliance with your local laws.

4. Accounts

You are responsible for the security of your account and for activity under it. Provide accurate information and keep it current. We may suspend or terminate accounts that breach these Terms.

5. Subscriptions & payments

Paid access is offered on a recurring subscription (currently €15/month, plus VAT where applicable). Card payments are processed by Whop as merchant of record. Where we offer crypto payment, it is handled by NOWPayments on a non-custodial basis.
Subscriptions renew automatically until cancelled. You can cancel any time through the billing portal; access continues until the end of the paid period.

6. Refunds

A subscription buys access to digital content that is made available to you immediately.

All sales are final. Except where the law requires otherwise, payments are non-refundable — including if you are dissatisfied with the picks, disagree with a call, or a pick loses.
You can cancel at any time to stop future renewals. Cancelling stops the next charge; it does not refund the current period, and your access continues until that period ends.
By subscribing you ask us to begin providing the content immediately and acknowledge that, to the extent permitted by law, this ends any statutory 14-day right of withdrawal once access has started.
Nothing here removes a refund right that cannot be excluded under the consumer law that applies to you.

7. Acceptable use

Do not resell or redistribute our content, scrape the Service, attempt to break access controls, or use the Service unlawfully.

8. Intellectual property

The Service, its content, brand and the three pundit characters are owned by Three Pundits OÜ. Your subscription grants a personal, non-transferable licence to access the content for your own use.

9. Your responsibility & assumption of risk

You use the Service and everything in it at your own risk. You are solely responsible for your own decisions and actions — including any bet, wager, stake or financial decision you make based on, or influenced by, our content, and for any resulting losses. We do not control and are not responsible for third-party bookmakers, exchanges or any account you hold with them.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. Odds, lines and results shown are sourced from third parties and may be inaccurate or out of date. Predictions are produced by AI and may be wrong. We do not warrant that the Service will be uninterrupted, error-free, or that any pick will be profitable.

11. Limitation of liability

To the fullest extent permitted by law, Three Pundits OÜ is not liable to you or to any third party for any damages of any kind — direct, indirect, special, incidental, punitive or consequential — or for any betting or gambling losses, lost profits, or losses arising from your use of (or inability to use) the Service, its content, any third-party operator, or any person's misuse of the Service. Where our liability cannot be excluded, our total aggregate liability is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, or (b) €100. Nothing in these Terms limits liability that cannot be limited under applicable law (including for death or personal injury caused by negligence, or for fraud).

12. Indemnification

You agree to indemnify and hold harmless Three Pundits OÜ and its operators from any claims, losses, liabilities and costs (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, your violation of any law or third-party right, or any betting or gambling activity you undertake.

13. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of third-party providers (data feeds, payment processors, hosting), network failures, or acts of government.

14. General

If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect. These Terms are the entire agreement between you and us regarding the Service. Our failure to enforce any right is not a waiver of it. You may not assign your rights under these Terms; we may assign ours to a successor of our business.

15. Changes

We may update these Terms. Material changes will be notified through the Service. Continued use after changes take effect constitutes acceptance.

16. Governing law

These Terms are governed by the laws of Estonia. Disputes are subject to the competent courts of Estonia, without prejudice to mandatory consumer protections in your country of residence.
